This document refers to the conditions under which the website www.ztour-travel.ro can be used, accessing it does not constitute the conclusion of the contract between the user and the Z Tour SRL travel agency.

Our website allows you to choose from a variety of travel services, with the possibility of making the desired reservation directly from the website, as well as paying for them through our online payment system. Z Tour has the capacity of Agent in relation to the Suppliers (hotels, guesthouses, others) and does not assume any responsibility for the packages and services offered by the Suppliers, not guaranteeing in any way the accuracy or the conditions of the services presented on this site.

2. GENERAL CONDITIONS FOR BOOKING AND PURCHASING SERVICES

Access to the website in order to place an order is allowed to any Customer/Buyer. The customer can buy tourist packages on our website in any of the following ways: creating an account on the website, logging in with a Facebook account, logging in with a gmail account or as a Visitor, without the obligation to register or log in to the website. The customer, regardless of the form in which he wishes to buy, assumes the obligation to provide the information requested of him in an adequate, complete, correct and real manner, as they appear specified in the content of the identity document. The customer has the obligation to comply with the provisions contained in these Terms and Conditions and to complete all the required fields in order to place and process the order, regardless of the way in which he understands to buy from the website. Any Customer may use our site only to view, order, pay and recommend our services. Our website may not be used to make any illegal, fraudulent payment, post or transmit any defamatory, threatening, obscene, indecent, inflammatory and similar material. We reserve the right to disallow the posting and/or to delete immediately and without any prior notice any comment on the site that contains inappropriate language, gross typographical errors, or that could harm our image and/or creates a state of discomfort for customers and visitors. We cannot guarantee uninterrupted and uninterrupted use of the Site. Errors, defects, viruses or other harmful behavior may occur on our website or servers that make it unavailable. Placing the reservation Placing the reservation is done by going through the following steps:

2. if you want to add more tourist packages to the basket, click on the "Continue shopping" button, if you want to complete the order, click on the "Finalize the order" button,

3. after selecting the desired tourist packages, if you do not have an account on the site and do not create an account on the site, enter your e-mail address

4. enter the billing data,
 
5. choose the payment method
 
6. check the field "agree to the Terms and conditions on the site"
 
7. you have the possibility to give your consent for receiving newsletters
 
8. place the order by clicking on the "Complete order" button
 
9. if you opt for offline reservation / request - this will be taken over by an operator and you will receive by e-mail the updated offer according to availability and the related rate
 
10. if you opt for online payment, you will be redirected to the page of the third-party payment operator to make the payment.
After making the payment, you are required to check the status of the reservation.
There is a possibility that, due to some exceptional situations (technical errors, overbooking at the hotel, errors in taking over the offers by the other partners integrated in the system and the like, without being limited), the status of the reservation will not be "Confirmed".
We cannot assume such errors and are not responsible for them, but we will provide full support to identify suitable solutions for the tourist who made a payment for an unconfirmed booking. If the alternatives identified by our agents are not accepted by the tourist, the sums paid by the tourist for the unconfirmed services will be returned.
A reservation is considered assumed by the Agency only when it has the status "Confirmed".

All rates on the website www.ztour-travel.ro are dynamic, related to services whose rates may change depending on availability At the time of payment Booking confirmation In the shortest time, you will receive a booking confirmation email, which certifies if the selected tourist package is available. The offers presented on the website are valid within the limits of available places. If the selected tourist package is no longer available at the time of placing the order, the order will be canceled automatically, receiving an information email/notification in this regard.
 
3. PAYMENT. billing
The prices displayed on the website, for each individual tourist package, include VAT, according to the legislation in force. Payment can be made by any of the following methods: - online, with the card, through the system: * PayU * PayPal The customer has the obligation to opt for the chosen payment method before placing the reservation, by ticking the corresponding option, according to the steps presented above. The Seller will issue an invoice to the Customer for the purchased tourist packages. In this sense, the Customer has the obligation to provide the Seller with all the information necessary to issue the invoice, according to the legislation in force. The invoice will be communicated to the Client, printed in material format, upon presentation of the Client at the agency headquarters to pick up the tickets. Z Tour does not have access to or store your card details, the card payment will be processed by the online payment processor. No other payment methods are accepted than those presented on the website and we do not assume any responsibility for card payments.
 
4. CANCELLATION OR MODIFICATION OF THE ORDER
The customer has a right to cancel or modify the service/tourist package booked or purchased provided that they inform Z Tour online, in writing or by phone of your intention. In certain cases you may not be able to cancel or modify certain tour services or you will need to meet certain requirements for these actions. In case of changes to a reservation such as: cancellation, refund, change of date, change of name, but not limited to these, Z Tour reserves the right to apply certain fees to cover the administrative costs resulting from this action. These fees are different from the fees imposed in this regard by the Supplier.
 
5. CONTRACTUAL LIABILITY By creating and using the Account, the Customer assumes responsibility for maintaining the confidentiality of the Account data (user and password) and for managing access to the Account, being responsible under the law for the activity carried out through his Account. By accessing the site, creating the Account, using the site, placing orders, etc. The customer expressly and unequivocally accepts the Terms and Conditions of the website in its latest version communicated within the website. After the creation of the Account, the use of the content is equivalent to the acceptance of the changes made to the Terms and Conditions of the Site and/or the updated versions of the Terms and Conditions of the Site. The customer is responsible for checking the final version of the Terms and Conditions whenever using the site. 6. COMPLAINT RESOLUTION PROCEDURE

Any dissatisfaction related to accessing, using, registering on our website, making a reservation, aspects related to the reservation made and others, will be communicated to us by email at office@ztour-travel.ro. Your complaint will be registered and you will receive a written response to the email address provided confirming that your complaint has been brought to our attention within no more than 48 hours on a business day. The Customer agrees not to publicize these grievances (on social networks, media, discussions at private parties or in any other way) subject to bearing the damages caused for the image damage caused to the Company by these actions. Afterwards, the complained situation will be analyzed and will be returned to you in writing with the answer in the legally agreed terms, within a maximum of 30 working days from the filing of the complaint.

 

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

The content of this website, including but not limited to the logo, stylized representations, symbols, images, photos, textual content and the like, are the exclusive property of Z Tour SRL. It is prohibited to copy, distribute, publish, modify, supplement, use, display, include, link, transmit, remove insignia, photos, images, pieces of text, display, sell, etc., the content, data, information, photos or other information found on the site, without the express permission granted in writing by Z Tour SRL. No Customer acquires, by using and accessing the site, any right or license to use any of the information on the site. No customer has the right to use any automatic or manual device to monitor the materials available on the site.

8. CONFIDENTIALITY

The customer has the obligation to maintain the confidentiality of the information he became aware of when accessing and using the site, as well as on the occasion of communications sent during registration, authentication, placing and honoring orders and other such aspects in connection with the use of the site the The customer is prohibited from disclosing to third parties his relations with Z Tour SRL without our express consent, provided beforehand in writing. 9. PERSONAL DATA PROCESSING

Z Tour SRL, as a personal data operator, processes the personal data of the persons concerned in accordance with the provisions of Law no. 190/2018 and the European General Regulation 2016/679 on the protection of personal data. According to the mentioned legislation, we have the obligation to administer the personal data provided by the Client, in safe conditions and only for the specified purposes. The purpose for which we ask the Client to provide personal data: to make it possible to confirm the Order, inform the Clients about the status of the Order, provide answers to the complaints placed, evaluate the services offered, commercial activities, promotion of the services, marketing, advertising, development, of market research, statistics, monitoring of sales and Customer behavior, administrative, media and the like. By accepting these Terms and Conditions, the Client declares that he agrees that his personal data will be included in our database and expressly consents that his personal data provided will be stored, used and processed indefinitely by Z Tour SRL and its collaborators/affiliates, but also to be assigned/transferred to its affiliates as well as to other entities in the country or abroad, based on a confidentiality commitment from them.

Based on a written request signed and sent to Z Tour SRL, at the address: Cluj-Napoca str. Anatole France, no. 62, Cluj county, you can exercise your right free of charge to one request per year regarding the confirmation of the fact that personal data are or are not processed. You can also request in writing, at the same address: the rectification, updating, blocking or deletion of data whose processing does not comply with the legal provisions, the transformation into anonymous data of the data whose processing does not comply with the legal provisions, notification to third parties who their data has been disclosed, if this is not impossible or does not involve an effort disproportionate to the legitimate interest that could be harmed. In the case of offering tourist services/packages on credit, the Client expressly agrees by accepting these Terms and Conditions that the legal entities with whom Z Tour SRL has entered into partnerships in order to purchase the services/packages on credit, process the Client's personal data in their own records in order to carry out the credit analysis and send them for consultation the information registered in the name of the Client in the database of the Credit Bureau. The information regarding the client's personal data can be transmitted to the Public Prosecutor's Office, the Police, the courts and other authorized bodies of the State, based on their request and within the limits provided by law.

10. ADVERTISING

When creating an account on the website and/or when placing an order, the Customer has the opportunity to express his agreement regarding the receipt of Newsletters. The newsletter is a means of periodic, exclusively electronic (e-mail, SMS) information on Goods, Services, Promotions, etc. to the Seller within a certain period, without any commitment on the part of the Seller with reference to the information contained therein. 11. FORCE MAJEURE

None of the contracting parties is responsible for the non-execution on time and/or the improper execution - in whole or in part - of any obligation falling under this contract, if the non-execution or improper execution of the respective obligation was caused by force majeure, as defined by law, for reasons beyond the control of the parties. The party invoking force majeure is obliged to notify the other party, within 5 (five) days, of the occurrence of the event and to take all possible measures to limit its consequences.

12. APPLICABLE LAW

The contract will be governed and interpreted in accordance with Romanian law. Any misunderstandings between the Seller and the Client in relation to the relations arising from this Contract are to be resolved amicably, and in case of failure, to be submitted to the materially competent courts in Cluj-Napoca.

13. FINAL PROVISIONS

This site is owned by Z Tour SRL, which grants you the right to access and use the site subject to your acceptance of these Terms and Conditions. By accessing and using the site you automatically and unequivocally agree to be bound by the Terms and Conditions on the site. Z Tour SRL has the right to modify the Terms and Conditions at any time, without prior notice, by posting the updated version on the website, and the Customer is obliged to read the Terms and Conditions whenever he accesses the website. The customer has the obligation to strictly comply with the Terms and Conditions on the website and cannot claim or defend himself with ignorance of the Terms and Conditions on the website, valid on the date of accessing, using and/or placing an order on the website. Z Tour SRL periodically organizes different Promotions that are announced on the website. Promotions begin their validity at the moment of their activation on the site and cease their validity at the moment of their inactivation on the site. Promotions cannot be combined with each other or with other discounts and are only valid while stocks last. The availability of a tourist service/package, whether it is part of a promotion or not, is announced by email after placing the order by the Customer.
